يسر محافظة البصرة / مديرية العقود الحكومية إعلان الوجبة الرابعة لعام 2015  والخاصة بـ قطاع(كهرباء نقل- تربية وزاري- تربية- انتاج طاقة)ضمن تخصيصات  (برنامج تنمية الأقاليم ) فعلى الراغبين من الشركات والمقاولين الأجنبية والعربية والعراقية من ذوي الخبرة والاختصاص مراجعة محافظة البصرة (مديرية العقود الحكومية/ قسم التعاقدات) الكائن في بناية ديوان المحافظة لشراء مستندات المناقصة (التندر) بسعر غير قابل للرد ومبين إزاء كل مناقصة اعتبارا من يوم الأحد المصادف 29/3/2015 علما إن آخر موعد لإيداع العطاءات الساعة الثانية ظهراً من يوم الأحد المصادف 19/4/2015علما انه قبل ذلك سيعقد مؤتمر خاص بالإجابة على استفسارات المشاركين في المناقصات بمقر مديريات الكهرباء والتربية وانتاج الطاقة قبل الساعة الثانية عشر من يوم الاحدالمصادف12/4/2015

 وبحضور ممثلي الشركات المتقدمة خلال فترة الفتح على أن يتضمن العطاء المقدم ثلاثة ظروف داخل ظرف واحد  تحتوى على ما يلي

1-   ظرف يتضمن العرض التجاري .

         2-    ظرف يتضمن العرض الفني .

         3-   ظرف يتضمن كافة المستمسكات المطلوبة :

شروط التقديم :

أ‌-      يلتزم مقدم العطاء بتقديم تأمينات أولية بمبلغ مقطوع بنسبة 3% من الكلفة التخمينية للمشاريع على شكل خطاب ضمان أو صك مصدق أو سفتجة نافذ إلى ما بعد انتهاء مدة نفاذية العطاء المحدد في وثائق المناقصة والتي تم تمديدها بمدة لا تقل عن 28 يوما  صادر من مصرف معتمد من عموم محافظات العراق ولا تقبل أي أوراق تجارية عند تقديم العطاءات كما لا يقبل أي عذر بشأن تأخير دفع التأمينات اعلاه على ان

يكون خطاب الضمان موجه الى الطرف الاول (محافظة البصرة- مديرية العقود الحكومية)ويذكر فيه اسم ورقم المناقصة المعنية وأن لا يكون خطاب الضمان مشروطاً وان يدفع حين الطلب

ب- يجب أن يكون المتقدم لشراء تندر المناقصة وكذلك مقدم العطاء إما المدير المفوض للشركة أو حاصل على توكيل أو تخويل رسمي من الشركة بالنسبة للشركات الأجنبية والعربية .

ج- يلتزم مقدم العطاء بتقديم الكفاءة المالية للشركة من خلال تقديم الحسابات الختامية للشركة  للسنتين الاخيرتين (مربحة) كحد ادنى مصادق عليها من قبل المحاسب القانوني للشركة ومؤيد من قبل المصرف .

د- يلتزم مقدم العطاء بتقديم (شهادة التأسيس، عقد التأسيس، النظام الداخلي للشركة، هوية غرفة التجارة، اجازة ممارسة المهنة) وحسب طبيعة العمل المعلن عنه مصدقة وفق القانون عند تقديم العطاء (نسخة ملونة عدد 2) .

ه- يلتزم مقدم العطاء بتقديم الأعمال المماثلة من خلال تقديم قائمة مفصلة بالأعمال التي قام بتنفيذها مع بيان الجهة التي قام بالعمل لحسابها ويعتمد في ذلك على الكتب الرسمية الصادرة عن الجهات الحكومية التي تؤيد القيام بالأعمال المحالة أو المنجزة على حسب حالته.

و- كتاب براءة الذمة من الهيئة العامة للضرائب / قسم الشركات نسخة ملونة نافذة للشركات المحلية.

ز- حجم الالتزام المالي من خلال تقديم قائمة مفصلة بالأعمال التي يقوم بتنفيذها حاليا والتي لم تنجز بعد عند تقديم العطاء والجهة التي يقوم بالعمل لحسابها .

ح- تقديم ما يؤيد الكفاءة بالتنفيذ مع بيان مؤهلات الجهاز الفني والمعدات والآليات التخصصية

ط- تلتزم الشركة بتقديم جدول تقدم عمل أولي للمشروع على ان يتم تقديم جدول عمل تفصيلي بعد توقيع العقد لغرض المصادقة عليه.

ي- في حالة اشتراك اكثر من مناقص في تقديم عطاء واحد لتنفيذ العقد تكون مسؤوليتهم تضامنية تكافلية في ذلك لتنفيذه على ان يقدم عقد المشاركة مصادق عليه اصولياً مع العطاء مع تقديم كافة المستمسكات المطلوبة للشركتين

ك- تقديم حركة مصرفية من قبل الشركة المنفذة ( حركة أموال الشركة في المصارف لستة اشهر الاخيرة)

ل- تلتزم الشركة بتقديم قرص ( CD ) يحتوي على جميع الأوراق والمستمسكات المقدمة من قبل الشركة

م- على الشركة تقديم كافة المستمسكات باللغة العربية و اللغة الانكليزية .

ن- تلتزم الشركة بتقديم جميع الوثائق الخاصة بالشركة وبمديرها المفوض ووكلاءه أو مخوليه مترجمة إلى العربية ومصدقة من قبل مترجم قانوني معتمد

س- على الشركة المجهزة التي ستحال عليها مناقصة قطاع الكهرباء تزويد ديوان محافظة البصرة- مديرية العقود الحكومية- قسم التعاقدات بكتاب صادر من الشركة المصنعة يؤيد بأن المواد المطلوبة ستجهز بالموعد المحدد في المناقصة على ان يكون هذا الكتاب مصادق من السفارة العراقية او من ينوب عنها في ذلك البلد

ملاحظة /على مقدمي العطاءات مراعاة ما يلي:؛

*أن يكون العرض نافذ حسب ما ورد في( أ) من الفقرة ( 3)

*أن تقوم الشركة بتثبيت عنوان مكتبها مع أرقام الهواتف والبريد الالكتروني على الظرف

*يتحمل من ترسو علية المناقصة أجور النشر والإعلان

*إذا صادف يوم غلق المناقصة عطلة رسمية يكون موعد الغلق في يوم الدوام الرسمي الذي يلي يوم العطلة

* يخضع هذا الإعلان إلى تعليمات تنفيذ العقود الحكومية رقم (2) لســ2014ـنة وكافة القوانين والتعليمات النافذة

* لا يجوز ذكر اي شرط أو تحفظ يخالف ما ذكر أعلاه

* يلتزم مقدم العطاء بإرفاق الأعمال المماثلة المؤيدة من قبل الجهة المستفيدة .

* تلتزم الشركة بالعمل مدة 16 / ساعة .

* في حالة طلب تمديد فترة الإعلان من قبل احد الشركات يكون تقديم طلب التمديد قبل سبعة أيام من تاريخ غلق المناقصة

* تلتزم الشركة بالمدة المحددة في الإعلان إلا في حالة تقديمها مدة اقل من المدة المحددة في الإعلان .

* أن الدرجة والصنف تخص الشركات المحلية فقط .

*في حال اختلاف المعنى بين اللغة العربية واللغة الانكليزية تعتمد اللغة العربية

لايتم اصدار قرار احالة الا بعد مصادقة وزارة التخطيط وورود تبويب المشاريع

* للدائرة الحق في إلغاء المناقصة في أي مرحلة من مراحلها وقبل الاحالة وعدم اجراء المفاضلة وحسب مقتضيات المصلحة العامة ولا يحق للمشتركين في المناقصة المطالبة بأي تعويض جراء ذلك.

The province of Basra / Directorate of government contracts is pleased to  announce  the fourth group for 2015 of the sector  (electricity transmission- ministerial education- education- power production)   within the allocations of (regions development program) thus, the interested specialized experienced foreign, and Iraqi companies should attend Basra Governorate Directorate of government contracts /Contracts Department) located in the governorate office  to  purchase tender documents  in a non-refundable that is explained in front of the tender from Sunday on 29/3/2015  noting that the last date for submitting proposals Sunday on  19/4/2015 at 2:00 pm knowing that a special conference will be held to reply participants' questions  in regard with tenders at the directorate of Electricity, education and power production offices  before twelve o'clock on Sunday12/4/2015
 in the presence of representatives of developed companies during the Opening period   that includes the three conditions of the tender submitted in one envelope
contains the following
1 –An envelope includes commercial offer.
2 – An envelope includes the technical offer.
3 – An envelope includes  all the  required documents  :

Presentation  conditions :
A - a bidder is committed to present initial insurances of a deducted sum of 3% of the projects estimated cost in a shape of letter of guarantee or certificated cheque in a period valid after the expiration of the tender validity specified  in the tender documents or which has been extended in no less than 28 days issued from an accredited bank of all provinces in Iraq. Any financial statement will not be accepted when  submitting tenders .Also, any excuse for delay the  above  insurances will not be accepted  in the condition that

Letter of guarantee should be directed to the first party (Basra Governorate- directorate of government contracts) mentioning the name and number of the tender.

Letter of guarantee should not be conditioned and should be paid on order.
B - The applicant for the purchase of  tender as well as the bidder must be either the authorized manager of the company or having authorization of the company for foreign and Arabic companies.
C – The bidder is committed to submit  the financial ability  of the company via presenting the bank statement of the company for the last two years (profitable) at minimum certified by the legal accountant and a supported for  the company by the bank.
D – The bidder is committed to present (a Certificate  of Registration , contract of registration, the interior system of the company, identity card of chamber of commerce, work license ) and due to the nature of the announced work certified according to law when submitting the tender (colored copy number 2)

E – The bidder is committed to provide similar works through providing a detailed list of the works which he implemented with  referring to the party for which he worked ,and is based on the official letters issued by government al authorities that certify the awarded or implemented works according to the work type . 
F - clearance  letter from the GCT / companies department colored  copy valid for local companies.
G - Size of the financial commitment via providing a detailed list of the works that he is implementing and which are not completed yet  at the tender offer  and the party for which he works for.

H – present what provide implementation efficiency with an offer statement of the technical qualifications, equipment and specialized machines

I- The company is obliged to present an initial work process schedule for the project and a detailed work schedule after signing the contract for approving.

J- In case of  sharing of more than one bidder in presenting a tender to perform the contract, their responsibility will be solidarity to perform and the sharing contract shall be presented with approval with the tender with all required documents of the two companies.
K – presenting a banking movement by executing company (the movement of the company's funds in the banks for the last six months)
L - the company is committed to provide a disk (CD) containing all the papers and documents provided by the company
M- the company must provide all the documents in Arabic and English.
N - the company is committed to provide all the documents of the company and its Director Commissioner, agents or his authorized people translated into Arabic and certified by a certified legal translator

O-  the supplying company  to which  the tender of electricity  will be awarded should supply Basra Governorate Office- Directorate of Government contracts- Contracts dept. with a letter issued by the manufacturing company certifying  that the required materials will be supplied at the fixed time in the tender in the condition that this letter approved by Iraqi Embassy or an agent in that country

Note / bidders to consider the following:;
* The show must be invalid as stated in (a) of paragraph (3)
* The company should install the office address with phone numbers and e-mail address on the envelope
* the bidder should  bear wages of publishing and advertising
* If it the closing happened an official holiday, the closing date of the official working day will follow the day of holiday 
* This announcement is subjected to the instructions and implementation of government contracts (2) 2014 and for all laws and regulations and invalid instruction 
* Not allowed to mention any condition or reservation disagree the above
* the bidder is committed  to attach similar pro-business by the beneficiary.
* The company is committed to work for 16 / hour.
* In the case of asking to extend the period before the announcement by one of the companies request will be providing an extension  before the seven days of the closing date
* Company is committed to the time limit in the announcement , except in the case provided for less than the period specified in the announcement.
* The degree and class belonging to local companies only.

*In case of the difference in meaning between Arabic and English, Arabic language is depended .

The awarding decision will not be issued unless planning  ministry assurance  and receiving  projects categorization .    

*- the directorate  has the right to cancel the tender in time  before awarding , and not to make the superlative according to the public interest. The participants have no right  to ask for any compensation.
