اعلان الوجبة السابعة لعام 2015 والخاصة بـ قطاع (الاسكان) ضمن تخصيصات (برنامج تنمية الأقاليم ) مناقصة (1) اسكان 2015 مشروع (انشاء 1500 وحدة سكنية في قضاء شط العرب ( المرحلة الاولى )

يسر محافظة البصرة / مديرية العقود الحكومية اعلان الوجبة السابعة لعام 2015 والخاصة بـ قطاع (الاسكان) ضمن تخصيصات  (برنامج تنمية الأقاليم ) مناقصة (1) اسكان 2015 مشروع (انشاء 1500 وحدة سكنية في قضاء شط العرب ( المرحلة الاولى ) ) بكلفة تخمينية (90،000،000،000) تسعون مليار دينار عراقيا لاغير وبمدة تنفيذ ( 365 يوم تقويمي)  على ان تكون الدرجة والصنف المطلوب ( ممتازة / انشائية ) وبعرض فني  (رقم التبويب 3،3،18،9) يكون التنفيذ باسلوب Tunnel Formwork  ضمن مجمعات كل مجمع يتكون من ثلاثة طوابق مساحة كل طابق بحدود (400) متر مربع يحتوي كل طابق على 4 وحدات سكنية وبمساحة لكل وحدة 90 متر مربع ويقع موقع المشروع في قضاء شط العرب ، فعلى الراغبين من الشركات الأجنبية والمحلية  من ذوي الخبرة والاختصاص مراجعة محافظة البصرة  (مديرية العقود الحكومية/ قسم التعاقدات) الكائن في بناية ديوان المحافظة لشراء مستندات المناقصة (التندر) بسعر غير قابل للرد  قدره (300 الف دينار عراقي )اعتبارا من يوم الأحد   المصادف 12/4 /2015 علما انه سيعقد مؤتمر خاص بالإجابة على استفسارات المشاركين في المناقصة بمقر ديوان محافظة البصرة- مديرية العقود الحكومية الساعة الثانية عشر ظهرا  حسب التوقيت المحلي لمحافظة البصرة من يوم ( الثلاثاء  ) المصادف 21 /4/2015  علما إن آخر موعد لإيداع العطاءات الساعة الثانية ظهراً بتوقيت محافظة البصرة المحلي من يوم (الثلاثاء  ) المصادف5/5 /2015 وبحضور ممثلي الشركات المتقدمة خلال فترة الفتح على أن يتضمن العطاء المقدم ثلاثة ظروف داخل ظرف واحد  تحتوى على ما يلي

1-     ظرف يتضمن العرض التجاري أصلي +2نسخ ملونة

2-     ظرف يتضمن العرض الفني أصلي +2نسخ ملونة

3-     ظرف يتضمن كافة المستمسكات المطلوبة

شروط التقديم:

1-     يلتزم مقدم العطاء بتقديم تأمينات أولية بنسبة 1%  بمبلغ مقطوع  من الكلفة التخمينية قدره(900.000.000 فقط تسعمائة مليون دينار عراقي لا غير) على شكل خطاب ضمان أو صك مصدق أو سفتجة نافذ إلى ما بعد انتهاء مدة نفاذية العطاء المحددة (120 يوم ) في وثائق المناقصة والتي يتم تمديدها  بمدة لا تقل عن 28 يوما  صادر من مصرف معتمد في عموم محافظات العراق ولا تقبل أي أوراق تجارية عند تقديم العطاءات كما لا يقبل أي عذر بشأن تأخير دفع التأمينات أعلاه على ان يكون خطاب الضمان موجه الى الطرف الاول (محافظة البصرة- مديرية العقود الحكومية) ويذكر فيه اسم ورقم المناقصة المعنية وأن لا يكون خطاب الضمان مشروطاً وان يدفع حين الطلب.

2-     يجب أن يكون المتقدم لشراء اوراق المناقصة وكذلك مقدم العطاء إما المدير المفوض للشركة أو حاصل على توكيل أو تخويل رسمي من الشركة .

3-     تقديم الكفاءة المالية للشركة( اجنبية او محلية ) من خلال تقديم الحسابات الختامية للشركة  للسنوات الخمس الاخيرة (مربحة)  مصادق عليها من قبل محاسب قانوني ومؤيدة من السفارة العراقية. وتكون مترجمة باللغة العربية

4-     يلتزم المشترك بتقديم ما يثبت الكفاءة المالية له وكما يلي:

أ‌-      رأس مال الشركة التأسيسي

ب‌-    قيمة الموجودات الثابتة

ج-   مصادر تمويل الشركة

5-     تقديم (شهادة التأسيس، عقد التأسيس، النظام الداخلي للشركة) وحسب طبيعة العمل المعلن عنه مصدقة وفق القانون عند تقديم العطاء (نسخة ملونة عدد 2) .

6-     تقديم الأعمال المماثلة من خلال تقديم قائمة مفصلة بالأعمال التي قام بتنفيذها مع بيان الجهة التي قام بالعمل لحسابها ويعتمد في ذلك على الكتب الرسمية الصادرة من الجهات الحكومية التي تؤيد القيام بالأعمال المحالة أو المنجزة على حسب حالته وتكون بما لا يقل مشروع مشابه بكلفة لاتقل عن 60% من كلفة المشروع الحالي

7-     حجم الالتزام المالي من خلال تقديم قائمة مفصلة بالأعمال التي يقوم بتنفيذها حاليا والتي لم تنجز بعد عند تقديم العطاء والجهة التي يقوم بالعمل لحسابها, على أن يكون حجم الإيرادات المالية المتحققة من المشاريع المشابهة لا تقل عن  نسبة 80% من الكلفة التخمينية لهذا المشروع اي لا تقل (72.000.000.000 فقط اثنان وسبعون مليار دينار عراقي لا غير ) خلال السنتين الاخيرتين.

8-     تقديم ما يؤيد الكفاءة بالتنفيذ مع بيان مؤهلات الجهاز الفني والمعدات والآليات التخصصية

9-     تقديم جدول تقدم عمل أولي للمشروع على ان يتم تقديم جدول عمل تفصيلي بعد المباشرة بالمشروع لغرض المصادقة عليه.

10-   في حالة اشتراك اكثر من مقاول  في تقديم عطاء واحد لتنفيذ العقد تكون مسؤوليتهم تضامنية تكافلية في ذلك لتنفيذه على ان يقدم عقد مشاركة مصادق عليه أصوليا مع العطاء مع تقديم كافة المستمسكات المطلوبة للشركتين

11-   تقديم حركة مصرفية من قبل الشركة المنفذة ( حركة أموال الشركة في المصارف لستة أشهر الأخيرة )

12-   تقديم قرص ( CD ) يحتوي على جميع الأوراق والمستمسكات المقدمة من قبل الشركة

13-   تقديم كافة المستمسكات باللغة العربية و اللغة الانكليزية .

14-   تقديم جميع الوثائق الخاصة بالشركة وبمديرها المفوض ووكلاءه أو مخوليه مترجمة إلى العربية ومصدقة من قبل مترجم قانوني معتمد وكذلك من السفارة العراقية

15-   تلتزم الشركة أو المقاول بتقديم شركة تصاميم تكون قد نفذت على  الاقل ثلاثة تصاميم في السنوات الخمس الأخيرة في مجال السكن ويقدم ما يثبت  تنفيذه تلك التصاميم ويقدم ايضا اتفاقية  شراكة بين الشركة أو المقاول والشركة المصممة مع كافة اوراق التأسيس والحسابات الختامية للسنوات الخمس الأخيرة (مربحة) للشركة المصممة مصدقة اصولياً من السفارة العراقية

16-   تقديم كافة المخططات وجداول الكميات الاولية مفصلة ومسعرة رقماً وكتابة ولكل فقرة على حدة بالإضافة الى المبلغ الإجمالي للمناقصة.

17-   لا يجوز لمقدم العطاء شطب اي بند من بنود مستندات المناقصة او اجراء اي تعديل فيها مهما كان نوعه.

18-   تلتزم الشركة بتقديم هيكل فريق المشروع واسماء مدير المشروع, مدير التصاميم, مدير المشتريات. برنامج ضمان الجودة, مع وصف خبراتهم وكفاءاتهم بالاضافة الى الاختصاصات الاخرى.

ملاحظة /على مقدمي العطاءات مراعاة ما يلي:؛

* يتم توقيع العقد خلال (14 يوم) بعد تبليغ المقاول بكتاب الاحالة .

* كل شرط او تحفظ يخالف ما ورد بمستندات المناقصة لا يعتد به.

* الالتزام بتقديم رقم الحساب الجاري بعد الإحالة ليتم تضمينه في متن العقد (مصارف عراقية معتمدة).

* تخضع اجراءات المناقصة والتعاقد الى تعليمات تنفيذ العقود الحكومية رقم (2) لسنة 2014والضوابط الصادرة لوزارة التخطيط وشروط المقاولة لاعمال الهندسة المدنية وكافة التعليمات والقوانين العراقية النافذة.

* إلزام كافة الشركات المتقدمة عند تقديم العطاء الاحتفاظ  بنسخ

اخرى   وذلك للأغراض التدقيقية.

* تلتزم الشركة بتحمل كلفة الفحوصات المختبرية التي تتطلبها المقاولة ويلتزم المقاول بتقديم شهادة فحص عالمية ويتحمل تكاليف نقل المواد وإيصالها إلى الموقع المخصص للعمل.

* للدائرة الحق في إلغاء المناقصة في أي مرحلة من مراحلها قبل الاحالة وعدم اجراء المفاضلة وحسب مقتضيات المصلحة العامة ولا يحق للمشتركين في المناقصة المطالبة بأي تعويض جراء ذلك.

*على مقدم العطاء بيان الموقع الالكتروني في وثائق العطاء البريد الالكتروني رقم واسم  عنوان الشخص المسؤول على متابعة الاستفسارات التي تخص العطاء.

* تلتزم الشركات المقاولة بضرورة مراجعة كل من وزارة التخطيط ووزارة التجارة /دائرة مسجل الشركات لغرض تكييف اوضاعهم المالية والقانونية وفق ما جاء بتعليمات تصنيف المقاولين رقم (3) لسنة 2009.بالنسبة للشركات المحلية والضوابط الخاصة بالنسبة للشركات الاجنبية

* في حالة حصول نزاع بين الطرفين تكون القوانين والمحاكم العراقية هي الجهة المخولة لحل النزاع.

*أن يكون العرض نافذ حسب ما ورد في( 1) من الفقرة ( 3)

*يتحمل من ترسو علية المناقصة أجور النشر والإعلان

*إذا صادف يوم غلق المناقصة عطلة رسمية يكون موعد الغلق في يوم الدوام الرسمي لليوم الذي يلي يوم العطلة

* في حالة طلب تمديد فترة الإعلان من قبل احد الشركات يكون تقديم طلب التمديد قبل سبعة أيام من تاريخ غلق المناقصة

* تلتزم الشركة بمدة تنفيذ المشروع  المحددة في الإعلان إلا في حالة تقديمها مدة اقل من المدة المحددة في الإعلان .

* تدفع مستحقات الطرف الثاني عن طريق الاعتماد المستندي (LC) ويتحمل الطرف الثاني نفقات واجور فتح الاعتماد داخل وخارج العراق

*في حال اختلاف المعنى بين اللغة العربية واللغة الانكليزية تعتمد اللغة العربية

The province of Basra / Directorate of government contracts is Pleased to announce seventh group for 2015   of (Housing) Sector within the allocations of (regions development program) of (1/housing ) 2015  (project of construction of 1500 housing units in Shatt Al Arab sub distract (first stage) )with estimated cost (90,000,000,000) only ninety billion IQD and completion time is

(365 calendar days) ,the required  grade and class should be(construction /excellent)with Tech. offer(classification NO. 3,3,18,9) the construction is being as  Tunnel Formwork within complex  everyone contains  three floors,  the area  of  each floor is 400 m2 , contains 4 housing units and the area of each unit is  90 m2 , located in Shatt –Alarab township  those interested of foreign and local  companies who have experience and competence should attend the governorate of Basra (Directorate of government contracts /Contracts Department) located in the governorate office  for the purchase of tender documents  at a non-refundable is (300 thousand IQ.) from Sunday   on 12/4/2015 noting that a special conference will be held to participants in question in the tender at the governorate office- directorate of government contracts twelve o'clock at Basra local time on Tuesday 21/4/2015  , noting that the last date for deposing tenders is Tuesday   on  5/5/2015 at 2:00 pm Basra local time in the presence of representatives of developed companies during the Open that includes the three conditions of the tender submitted in one envelope contains the following:-

1 - envelope includes commercial offer  original+ 2 colored copies

2 – envelope includes the technical offer original+ 2 colored copies

3 – envelope includes all the required documents

Submitting conditions:

1.     the bidder is committed to present   initial insurances of  1% with deducted sum which is estimated of (900,000,000) (only nine hundred million IQD)  under a letter of guarantee or certificated cheque in a period invalid after the expiration of the permeability of the tender (120 day )specified in the tender documents and which has been extended in no less than 28 days issued from an accredited bank in all provinces in Iraq ,any commercial paper will not be accepted when submitting tenders also any excuse for delay the  above  insurances will not be accepted  in the condition that letter of guarantee should be directed to the first party (Basra governorate- directorate of government contracts) mentioning the name and number of the tender .Letter of guarantee should not be conditioned and should be paid on order.

2.     The applicant for the purchase of tender as well as the bidder must be either the authorized manager of the company or having authorization of the company.

3.     Provide   the financial efficiency of the company (local or foreign)   through the presentation of the final accounts of the company for the last five years (gain )  certified by a legal accountant and confirmed by the Iraqi embassy and should be translated into Arabic language 

4.     The participant is committed to present what proves the financial efficiency as following:

a.     The company's founding capital

b.     b-The value of asset

c.     c-The company's funding sources

5.     provide  (establishing certificate, establishing contract, the interior system of the company) and due to the nature of the announced work certified according to law when submitting the tender (colored copy number 2)

6.     provide the similar works through providing a detailed list of the works which he implemented with  referring to the party for which he worked ,and is based on the official letters issued by government agencies that approve allocated or completed business on his case and should be no less than one similar project with cost no less than 60% of the current project .

7.     total amount  of the financial commitment through providing a detailed list of the works that he is implementing and which are not completed yet  during the tender offer  and the party for which he works . The financial incomes of the similar projects should be no less than ( 72,000,000,000 only seventy two billions  IQD)  of 80%  of estimated coast of   current  project financial cost during the last two years.

8.     presenting what provide implementation efficiency with an offer statement of the technical qualifications, equipments and specialized machines.

9.     presenting an initial work advance table for the project in the condition that a detailed work table should be presented after beginning the project for approving.

10.   In case of  JV of more than one bidder in presenting a tender to perform the contract, their responsibility will be solidarity to perform and the JV shall be presented with approval with the tender with all required documents of the two companies.

11.   Provide  a bank statement   of the  company (the statement should be for  the last six months)

12.   submit  all the papers and documents of the company soft( CD)

13.   all the documents  of the company in Arabic and English language .

14.   all the documents that related to the company , Director, agents or authorized people  should be in Arabic  language and certified by accredited  legal translator and  the Iraqi embassy

15.   the company must present specialized  designer  in the field of housing complex has designed  a minimum   of three projects  in the last five years ,also  the company should submit a joint venture  agreement  attached with certificate of registration bank statement for the last five years(gain )   of the designer ( all documents must be certified by Iraq embassy ).

16.   the bidders has to submit initial design and initial BoQs with  price should be in numbers and writing for each item and  the total cost of the tender

17.   the bidder is not allowed to cancel  any of the tender documents items or making any amendment of whatever kind.  .     

18.   The company has to submit organization structure   showing   the names of projects manager, designs manager,  procurement  manager and, quality manger with description of their experience  in addition to other specializations.

Note/ the bidders  must consider the following :

*- the contract is to be signed in  (14 days) after the contractor being notified  by awarding  letter.

*- every  condition or reservation that contradicts with what mentioned in the  tender documents would  not  be considered.

*-the bidder should submitted   the current account number of the company  immediately  after  the awarding to  included  in the contract (accredited Iraqi banks).

*-  The tender and contracting procedures are subjected to the instructions of government contracts (2) 2014  , the instructions issued by the Ministry of Planning and all  contracting conditions of civil engineering works  and all  the instruction  are  laws  and instructions that are valid in Iraq  .

*- all  the bidders  has to keep  another copies  for auditory purposes

*- the company is committed to endure the cost of the laboratory tests that the bid requires. The contractor is committed to present a global test certificate and endure the costs of transferring and delivering the materials to the location.

*- the governorate of Basra  has the right to cancel the tender at any stage  before the awarding , without making any  comparison and according to the public interest. The participants in the tender do not have the right to demand any compensation.

*- the bidder has to submit all his contacts details  ( company website  contact person e-mail, phone  number) in the bidding documents .

*- the contracted companies are necessarily committed to go to the Ministry of Planning and the Ministry of Trade/ the office of companies register for illustrating their financial  and legal situations according to the instructions of contractors classification number (3) for 2009 according to local companies and special instruction s for foreign companies  .

*- In case of any dispute between the two parties, Iraqi laws and courts are the authorized party to solve the dispute.

*-The show must be invalid as stated in (1) of paragraph (3)

* the bidder should  pay  coast  of publishing and advertising

* If it the closing  date is official holiday, the next working day   will be  the closing date to receive  the bids

* all the extension time must be  a requested by seven days before closing date 

* Company is committed to the time of project implementation which is  limited  in the advertisement, except in the case provided for less than the period specified in the announcement.

* Second party payments are paid by letter of credit (LC) the second party has to pay   expenses and fees of ( LC) in and outside of Iraq   

*In case of the difference in meaning between Arabic and English, Arabic language is based  .
